How do they choose between adjudication and mediation?  Does their preference for court mediation lead to satisfactory outcome for all stakeholders, or does it actually deprive environmental cases the opportunities to clarify ambiguous laws and establish important legal principles? Does mediation impede utilizing the legal tools to advance China's environmental governance, and inhibit the development of a professional and competent judiciary capable of changing the rule of law landscape in China?

Professor Liu will discuss the tension between mediation which provides social and political stability and the need for judges to push the boundaries of what is permissible in this new area of law.
