Tribal Sovereignty & the Supreme Court: Putting the Genie of Judicial Plenary Power Back in the BottleThe Supreme Court often has the final word on what the law means and legal advocates need to frame their arguments within the confines of the Court's decision. However, sometimes the Court is wrong, and legal advocates need to learn how to strategize in the face of bad precedent. Professor Bruce Duthu of Darmouth, and formerly of Vermont Law School, will guide participants in this workshop with an eye for doing just that. Specifically, participants will focus on what can be done when the Supreme Court attacks tribal sovereignty.
