This conference explores the regulatory takings issue as it relates to land use and environmental regulations. The conference brings together a diverse group of leading scholars and experienced practitioners to discuss cutting-edge issues raised by recent decisions and pending court cases. Some of the topics to be discussed include the pending U.S. Supreme Court case of Arkansas Game & Fish Commission v. United States, recent and pending court cases arising from regulation of surface and groundwater resources, current issues in assessing the economic impact of regulatory action in takings cases, sea level rise due to climate change and its effects on coastal development, and the latest takings developments on the international stage including the current status of investor-state expropriation claims under international trade agreements.

Key Questions to be Addressed
Is the government liable for a taking for causing or contributing to flood damage?
Can government regulation of surface waters or groundwater lead to a takings claim?
How should the courts measure “economic impact” in takings cases?
How can regulators respond to the challenge of rising sea levels due to climate change?
How do the evolving takings standards in other countries and under international law differ from US takings standards?
